Alternative Dispute Resolution (ADR) refers to any means of settling private disputes outside of the courtroom. ADR typically includes early neutral evaluation, negotiation, conciliation, mediation arbitration etc. With heavy volume in Courts, rising costs of litigation, and time delays continue to plague litigants, ADR is seen as the future.
Upaay is a not-for-profit association of members from the legal fraternity with a clear goal to create awareness, research, innovate and strengthen the ADR methods in order to improve the justice delivery system. It envisions a future where people live to the fullest and achieve their dreams, with a new outlook to dispute resolution in this modern era. To become a member of the association, the annual charges are as under: -
a) Designated Senior Advocate 7500/- INR
b) Advocate (Having practice of more than 10 years) 5,000/- INR
c) Advocate (Having practice of 10 years or less) 2,500/- INR
d) Non-Active Member 1000/- INR
e) Associate Member (Other Organisations) 5,000/- INR
f) Corporate Member 15,000/- INR
g) Law Student Member 500/- INR
In short, the benefits of using Alternative Dispute Resolution (ADR) over traditional legal proceedings include cost-effectiveness, time efficiency, flexibility, preservation of relationships, confidentiality, informality, empowerment of parties, access to specialized expertise, global applicability, and a reduction in judicial backlog.

While Alternative Dispute Resolution (ADR) can be used for a wide range of disputes, it may not be suitable for all types. ADR is particularly effective for commercial, employment, family, community, construction, intellectual property, healthcare, and environmental disputes. However, its applicability depends on the nature of the conflict, and certain situations, such as criminal cases or matters requiring legal precedent, may be better addressed through traditional legal proceedings. Successful ADR implementation also relies on the voluntary participation of all parties involved.
Upaay does not provide ADR services, but enrols members who are ADR practitioners, experts, academicians and enthusiasts.
Many business-to-business disputes have been successfully resolved through arbitration or mediation, allowing companies to maintain relationships and avoid lengthy court battles.
